🚲 Bike Rental Agreement & Terms of Service

1. 📘 AGREEMENT OVERVIEW

This Bike Rental Agreement (“Agreement”) is entered into between [Your Company Name] (“Company”) and the renter (“Customer”).

By renting a bicycle, the Customer agrees to all terms outlined below.

2. 💳 SECURITY DEPOSIT (30% RULE)

2.1 Required Deposit

• Customer must pay a security deposit equal to 30% of the retail market value of the rented bicycle.

Example:

• $1,000 bike → $300 deposit

2.2 Deposit Purpose

The deposit covers:

• Damage to the bicycle

• Theft or loss

• Late returns

• Unpaid fees

2.3 Refund of Deposit

• Deposit is refundable upon return of the bicycle:

  • In original condition (normal wear and tear excepted)

  • After inspection by the Company

• Any damages or fees will be deducted from the deposit

3. 🚴 RENTAL PERIOD & FEES

• Rental periods may be weekly, monthly, or yearly

• Late returns may result in:

  • Additional daily fees

  • Possible forfeiture of deposit

4.🔧 DAMAGE & REPAIR RESPONSIBILITY

4.1 Customer Responsibility

The Customer is fully responsible for:

• Any damage to the bicycle

• Mechanical issues caused during rental

• Cost of repair or replacement parts

4.2 Total Loss / Theft

If the bike is:

• Stolen

• Lost

• Damaged beyond repair

👉 Customer is responsible for full retail replacement value, minus deposit already paid.

5. 🔐 CARE & USE OF BIKE

Customer agrees to:

• Use the bicycle safely and responsibly

• Follow all traffic laws

• Not use the bike for:

  • Illegal activities

  • Racing or stunt riding

  • Commercial delivery services (unless approved)

6. 🚫 PROHIBITED USE

Customer may NOT:

• Sublease or lend the bike to others

• Modify or alter the bike

• Use the bike under the influence of drugs/alcohol

7. ⚠️ ASSUMPTION OF RISK

Customer acknowledges:

• Riding a bicycle involves inherent risks, including injury or death

Customer agrees to:

• Assume all risks

• Ride at their own responsibility

8. 🛑 LIABILITY WAIVER

To the fullest extent permitted by law:

• [Your Company Name] is NOT liable for:

  • Injuries

  • Accidents

  • Property damage

  • Death resulting from use of the bicycle

9. 📍 INSPECTION REQUIREMENT

• Customer must inspect the bicycle before use

• Any pre-existing damage must be reported immediately

Failure to report = acceptance of bike condition

10. 🕒 LATE RETURNS

• Late returns may incur:

  • Daily penalty fees

  • Additional rental charges

After 7 days of non-return:
👉 Bike may be considered stolen, and legal action may be taken

11. ⚖️ LEGAL & TEXAS COMPLIANCE

This Agreement is governed by the laws of the State of Texas.

Texas-Specific Notes:

• Theft or failure to return rented property may be prosecuted under Texas Penal Code (Theft of Service)

• Customers may be held liable for:

  • Replacement costs

  • Legal fees

12. 🔐 INDEMNIFICATION

Customer agrees to:

• Hold harmless [Your Company Name], its owners, employees, and affiliates

• From any claims, damages, or liabilities arising from use of the bicycle

13. 💳 PAYMENT AUTHORIZATION

Customer authorizes the Company to:

• Charge their payment method for:

  • Damages

  • Repairs

  • Late fees

  • Replacement costs

14. 📲 ELECTRONIC SIGNATURE AGREEMENT

By signing electronically, Customer agrees that:

• Their electronic signature is legally binding

• It is equivalent to a handwritten signature

This complies with:

• UETA (Uniform Electronic Transactions Act)

• ESIGN Act

15. 📑 TERMINATION

Company reserves the right to:

• Terminate rental at any time for:

  • Violation of terms

  • Unsafe behavior

No refund may be issued in such cases

16. 📝 CUSTOMER ACKNOWLEDGEMENT
